These Terms of Service ("Terms") govern your access to and use of the website lakeview-webdev.com and the services provided by Lakeview Web Development ("we," "our," or "us"). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
Our Services
Lakeview Web Development provides web design and development, search engine optimization (SEO), custom software, logo and graphic design, and related services. The specific scope, deliverables, and timeline for any project will be described in a separate proposal, quote, or written agreement between you and us. In the event of a conflict, that project agreement takes precedence over these Terms.
Quotes, Pricing, and Payment
- Quotes are valid for the period stated in the quote and are based on the scope described at the time.
- Many services are offered on a recurring monthly plan that may include hosting, maintenance, edits, and SEO updates. Monthly plans continue until cancelled in accordance with these Terms or your project agreement.
- Fees are due as set out in your quote or invoice. Late or missed payments may result in suspension of services, including hosting and site availability, until the account is brought current.
- Unless stated otherwise, quoted prices exclude any applicable taxes and third-party costs (such as domain registration or premium plugins/services).
Client Responsibilities
To deliver our services effectively, you agree to:
- Provide accurate, complete, and timely information, content, and materials.
- Ensure you own or have the rights to all text, images, logos, and other materials you provide to us.
- Review deliverables and provide feedback within a reasonable timeframe.
- Use the website and services in compliance with all applicable laws.
Revisions and Content
The number of design revisions included in a project will be specified in your project agreement. Additional revisions or work outside the agreed scope may be subject to additional fees. You are responsible for the accuracy and legality of any content you supply for use on your website.
Intellectual Property and Ownership
Upon full payment of all applicable fees, you will own the final custom website deliverables produced specifically for you, except for any third-party components, open-source libraries, fonts, stock assets, or tools, which remain subject to their own licenses. We retain the right to reuse general skills, techniques, and non-client-specific code, and to display completed work in our portfolio unless you request otherwise in writing.
Hosting and Third-Party Services
Our services may rely on third-party providers (for example, hosting, analytics, or email platforms). We are not responsible for outages, changes, or issues caused by these third parties, though we will make reasonable efforts to assist. Your use of third-party services may be subject to their own terms.
Cancellation and Termination
You may cancel a recurring plan in accordance with the notice terms in your project agreement. Upon cancellation or termination, ongoing services such as hosting, maintenance, and edits will stop, and any outstanding balances become due. We may suspend or terminate services if you materially breach these Terms or fail to make payment.
Disclaimer of Warranties
Our website and services are provided on an "as is" and "as available" basis. While we strive for high quality and reliable performance, we do not warrant that services will be uninterrupted, error-free, or that specific results — such as particular search engine rankings or traffic levels — will be achieved.
Limitation of Liability
To the fullest extent permitted by law, Lakeview Web Development will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or business, arising out of or related to your use of our website or services. Our total liability for any claim will not exceed the amount you paid to us for the services giving rise to the claim in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Lakeview Web Development from any claims, damages, or expenses arising out of content you provide, your use of the services, or your violation of these Terms or any applicable law or third-party right.
Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.
Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
